On Friday, Aug. 13, Texas Judge Matthew Kacsmaryk ordered the reinstatement of former U.S. President Donald Trump’s “Stay in Mexico” policy, which requires those seeking asylum in the United States to wait in Mexico for their court hearings.

The 2019 law was previously given a memorandum by National Security Secretary Alejandro Mayorkas this past June, until Kacsmaryk ruled that the administration of U.S. President Joe Biden could not shut down the program until it is “legally rescinded.”

Kacsmaryk likewise stated the policy’s temporary end failed to consider “several of the main benefits” of the program, including relieving pressure on immigration officials, though human rights groups opposing the stay in Mexico policy say it violates the migrants right to due process.

The Biden administration has seven days to file an appeal before the ruling takes effect nationwide.
